Terms of Service

1) Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with permission of a parent or legal guardian.

2) Account Registration and Security

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information and keep it updated.
• You must notify us if you suspect unauthorized access to your account.

3) The Services

Scutely provides tools for tracking reptiles/animals, husbandry, breeding projects, records, and related features. The Services may evolve over time, and we may add, modify, or remove features.

4) User Content

"User Content" includes information, text, images, and files you upload or enter (e.g., animal profiles, photos, notes, and logs).

• You retain ownership of your User Content.
• You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content only as needed to operate and provide the Services.
• You represent that you have the rights necessary to upload your User Content and that it does not violate law or the rights of others.

5) Community, Sharing, and Public Profiles

If the App includes public profiles or sharing features, you are responsible for what you choose to share. We may remove content or restrict features if it violates these Terms.

6) Prohibited Conduct

You agree not to:

• Use the Services for unlawful, harmful, or fraudulent purposes.
• Attempt to gain unauthorized access to accounts, systems, or data.
• Interfere with or disrupt the Services (scraping, reverse engineering, abusing rate limits).
• Upload malware or compromise security.
• Harass, threaten, or impersonate others.

7) Content Standards

You will not submit content that:

• Contains pornography, sexually explicit content, or nudity.
• Includes hate speech, harassment, threats, or violent content.
• Contains excessive profanity or obscene material.
• Depicts or promotes animal cruelty, neglect, or abuse.
• Facilitates illegal activity or violates applicable laws.
• Infringes intellectual property or privacy rights of others.

8) Animal Sales, Transfers, and Legal Compliance

Scutely includes features for recording animal listings, sale prices, and ownership transfers. Scutely is a record-keeping tool: we are not a party to, and do not broker, verify, or guarantee, any sale or transfer between users.

• Laws governing the keeping, breeding, purchase, sale, import, export, and transport of animals vary widely by country, state/province, and municipality — including CITES and other wildlife regulations, invasive species rules, venomous species restrictions, and permit requirements.
• You are solely responsible for ensuring that any animal you keep, breed, list, sell, or transfer and any transfer you accept complies with all applicable laws in your location and the other party's location, before completing it.
• We do not verify the legality of any species, listing, sale, or transfer, and we may remove listings or restrict features that we believe violate these Terms or applicable law.
• Government requests: we do not voluntarily provide members' collection or species data to government entities. We disclose such data only in response to valid, binding legal process; we will seek to narrow or challenge requests we believe are overbroad or improper; and where the law permits, we will notify you before disclosing your data. 9) Enforcement; Suspension and Bans

We reserve the right to remove content, warn users, limit features, or suspend/terminate accounts if we believe Terms were violated or conduct was abusive or inappropriate.

10) Advertising

The App may display advertisements, including ads personalized based on species and traits you track. Details are in our Privacy Policy.

11) Subscriptions, Purchases, and Billing

• App store terms apply: purchases are processed by Apple or Google.
• Subscription management: manage or cancel through your app store account settings.
• No refunds except where required by law or app store policies.

12) Third-Party Services

The Services may integrate with third-party services (sign-in providers, analytics, crash reporting, payment tooling). We are not responsible for their content or practices.

13) Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Services, you agree to our data practices.

14) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTLE REPTILES LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE EVENT (OR $100 IF NOTHING WAS PAID).

16) Indemnification

You agree to indemnify and hold harmless Castle Reptiles LLC from claims arising from your use of the Services or violation of these Terms.

17) Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or pose a risk.

18) Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in the App.

19) Governing Law

These Terms are governed by the laws of the United States and the state where Castle Reptiles LLC is established.
